The declaration of being free to marry granted by the Church of England in the light of the Roman Catholic Church canon law

Przedmiotem artykułu jest przedstawienie podstaw unieważnienia małżeństwa w prawie kanonicznym Kościoła katolickiego oraz w prawie Kościoła anglikańskiego. Autorka zwraca uwagę, że te przesłanki w Kościele anglikańskim są szersze niż w Kościele katolickim. Następnie przedstawia problem uznania unieważnienia małżeństwa w prawie Kościoła anglikańskiego przez władze Kościoła katolickiego w kontekście zawarcia nowego małżeństwa w Kościele katolickim. Przyjmując, że takie uznanie jest dopuszczalne.

The legal grounds for marriage annulment in canon law of the Church of England and the Roman Catholic Church are presented in this article. The author points out that these legal grounds have broader scope within canon law of the Church of England rather than the Roman Catholic Church. Afterwards, the issue of recognition of marriage annulment ruled on the ground of the Anglican Canon law in the light of permissibility of entering into new marriage under the Roman Catholic Church law is analyzed. In conclusion, such recognition is deemed to be fully acceptable.
