Do androids dream of copyright? : the art of creative robots in the light of current copyright law based on the "The next Rembrandt" case

Choć dotychczas sztuczna inteligencja była jedynie domeną fantastyki naukowej, w ostatnich latach stała się przedmiotem dużego zainteresowania również nauki i prawa. Rozwój technologiczny i ostatnie osiągnięcia w dziedzinie cybernetyki doprowadziły do powstania tak nowatorskich rozwiązań, jak kreatywne roboty, które potrafią tworzyć dzieła sztuki odrywające się od ludzkiego rzemiosła i wpływu człowieka. Wiodącym tego przykładem jest obraz The Next Rembrandt, stanowiący doskonałą imitację stylu i techniki malarskiej Rembrandta, stworzony jednakże przez komputer. Dotychczas prawo autorskie uznawało programy komputerowe generujące utwory jedynie za narzędzia pomocne człowiekowi w procesie twórczym. W przypadku jednak podejmowania kluczowych dla powstania utworu decyzji nie przez człowieka, lecz właśnie przez robota, pojawia się pytanie, czy tak powstałe dzieło zasługuje na ochronę prawnoautorską. Niestety nie można nie oprzeć się wrażeniu, że aktualne rozwiązania prawne na tym polu nie biorą takiego scenariusza pod uwagę, a interwencja ustawodawcy w tej kwestii prędzej czy później okaże się nieunikniona. Istotne przy tym jest bieżące reagowanie na pojawiające się coraz to nowsze wyzwania, jakie rozwój nowych technologii - na czele ze sztuczną inteligencją - stawia przed prawem autorskim.

Although artificial intelligence has hitherto been the domain of science fiction, in recent years it has attracted vivid interest from science and law as well. Technological development and the latest achievements in the area of cybernetics have led to creation of such innovative solutions as creative robots that can make works of art detaching from human craftsmanship and influence. The prime example of such may be The Next Rembrandt painting, a perfect imitation of Rembrandt's style and technique, made by a machine. Computer programs that generate works have been so far recognised by copyright law only as tools that people use in the creative process. However, in case of making the key decisions for the creation of a work not by a man, but by a robot, the question arises whether the composition thus created deserves copyright protection. Unfortunately, one cannot resist the impression that current legal solutions in this field do not take such scenario into account, and legislator's intervention in this matter sooner or later will be inevitable. It is crucial to respond to new and emerging challenges that development of new technologies, including artificial intelligence, poses to copyright law.
