The concept of corporate secret and its protection in Polish civil procedure : selected issues

Celem niniejszego artykułu jest próba analizy skuteczności ochrony tajemnicy przedsiębiorstwa w postępowaniu cywilnym po implementowaniu dyrektywy Parlamentu Europejskiego i Rady (UE) nr 2016/943 z dnia 8 czerwca 2016 r. Na początku tekstu autor wyjaśnia czym jest tajemnica przedsiębiorstwa oraz jaki jest jej charakter prawny. Jednocześnie wskazuje jaka jest relacja tajemnicy przedsiębiorstwa do pojęcia know-how, które jest często używane zamiennie. Następnie opisane zostały wybrane instrumenty, którymi dysponuje strona w postępowaniu cywilnym, a które mają służyć ochronie opisanych dóbr w toku postępowania. Na samym końcu autor stara się odpowiedzieć na pytanie, czy wskazana dyrektywa spełniła swoją rolę i czy przyczyniła się do skuteczniejszej ochrony informacji poufnych na gruncie polskich przepisów.

This article aims to present current Polish regulation in the field of legal protection of trade secrets. At the beginning author will discuss the meaning of this term and after that he will elaborate the legal nature of it. He will also try to show relation between "trade secrets" and "knowhow". Then he will describe what legal instruments are availible for a businessmen to protect their trade secrets in Polish civil court. At the end, author will present if the EU directive 2016/943 solved procedural problems that should help to protect trade secrets.
