The presumption of constitutionality and legal system : the comparative analysis of Polish and Slovak constitutions

W piśmiennictwie szeroko omówiono zagadnienie domniemań prawnych. Nie doczekały się takiego opracowania domniemania prawnicze. Jednym z nich, ostatnio dość często przywoływanym, jest domniemanie zgodności aktu niższego rzędu z konstytucją. Poniższe opracowanie jest próbą wyeksponowania najważniejszych cech domniemania konstytucyjności i uogólnienia tych rozważań dla szerszej grupy narzędzi interpretacyjnych, jaką stanowią domniemania prawnicze. Szczególnie zwraca się w tekście uwagę, iż nie wymagają one wyraźnej podstawy prawnej - tworzy je doktryna przy pomocy wykładni aktu normatywnego. System prawny ma więc wpływ (choć pośredni) na to, czy i w jakim zakresie będzie możliwe stosowanie w nim pewnych narzędzi interpretacyjnych. W tym kontekście autor tekstu stawia pytanie, jak struktura aktów prawnych, relacje między nimi i zasady danego systemu oddziałują na posługiwanie się w tym systemie pojęciem domniemania konstytucyjności. W tym opracowaniu problem ten został zbadany na przykładzie Konstytucji Rzeczypospolitej Polskiej i Konstytucji Republiki Słowackiej.

The issue of legal presumption has been profoundly discussed in the Polish legal doctrine. However, no deep study has covered the juristic presumptions. One of them, called the presumption of constitutionality, has been widely discussed recently. This article aims to emphasise the most important features of the presumption of constitutionality in order to apply them to the other interpretative tools. In particular, the author focuses on the basis of juristic presumptions. It is the whole act, from which those juristic presumptions are interpreted, no explicit provision is deemed necessary. Legal system may influence, though indirectly, the use of interpretative tools. The author poses a question how the structure of legal acts, the relation between them, as well as the rules of a particular legal system determine the application of the presumption of constitutionality in the respective legal systems. The analysis of the problem in question was based on the examination of the Constitution of the Republic of Poland and the Constitution of the Slovak Republic.
