Selected issues of penalization for driving while being under the influence of alcohol : assessment of experiences from Poland (DWD)

Analizie poddano zagadnienia związane z prowadzeniem pojazdów pod wpływem alkoholu. Przytoczono definicję stanu nietrzeźwości w rozumieniu ustawy z dnia 6 czerwca 1997 r. - Kodeks karny (Dz.U. z 1997, Nr 88, poz. 553) oraz w rozumieniu ustawy z dnia 26 października 1982 r. o wychowaniu w trzeźwości i przeciwdziałaniu alkoholizmowi (Dz.U. z 1982, Nr 35, poz. 230), a także stanu po użyciu alkoholu. W następnej kolejności analiza obejmowała przesłanki odpowiedzialności karnej oraz sankcji karnych za prowadzenie pojazdu w stanie nietrzeźwości i w stanie po użyciu alkoholu. Ponadto analiza zawiera zmiany na przestrzeni lat przepisu art. 178a k.k. oraz art. 87 ustawy z dnia 20 maja 1971 r. - Kodeks wykroczeń (Dz.U. z 1971, Nr 12, poz. 114) wraz z uwzględnieniem kontrawencjonalizacji czynu z kategorii przestępstw do kategorii wykroczeń. W dalszej kolejności analizie poddano statystyki związane z wyżej wymienionymi czynami, a także czynniki jakie wpływają na osoby, które decydują się na prowadzenie samochodu po spożyciu napojów alkoholowych.

This report covers analysis of legal issues related to driving under the influence of alcohol. The definition of the state of intoxication within the meaning of the Penal Code Act of the 6th June 1997 - (Journal of Laws 1997, No. 88, item 553) - ("Penal Code of the Republic of Poland") and within the meaning of the Act of 26th October 1982 on Upbringing in Sobriety and Counteracting Alcoholism (Journal of Laws 1982, No. 35, item 230), as well as the state after consuming alcohol. Next, the analysis includes legal premises of criminal liability and criminal sanctions for driving a vehicle under the influence of alcohol and driving while intoxicated. In addition, the analysis includes changes over the years of the provision of art. 178a of Penal Code and art. 87 of the Act of 20th May 1971 - Code of Offenses (Journal of Laws 1971, No. 12, item 114), including the contravention of the criminal act to the category of offenses. Next, the statistics related to the aforementioned acts were analyzed, as well as factors that affect people who decide to drive a car after consuming alcoholic beverages.
