Evolution of international criminal justice : International Criminal Court

Celem niniejszej pracy jest przedstawienie ewolucji międzynarodowego sądownictwa karnego jako reakcji na zbrodnie wojenne, a także przedstawienie jego obecnego stanu i scharakteryzowanie Międzynarodowego Trybunału Karnego. Dogłębnej analizie poddane zostały kolejne trybunały międzynarodowe, ich charakterystyka i podstawy normatywne. Szczególny nacisk został położony na analizę Międzynarodowego Trybunału Karnego. Przedstawiony został proces jego ustanowienia, procedura wejścia w życie Statutu Międzynarodowego Trybunału Karnego, a także istota i podstawowe kwestie związane z funkcjonowaniem MTK. Omówione zostały podstawy orzekania Trybunału oraz jego organizacja wewnętrzna. W niniejszym opracowaniu zaprezentowano również zakres jurysdykcji Trybunału, zagadnienie wykonywania wyroków i zakres możliwych do orzeczenia kar. Na koniec przedstawiona została krytyczna ocena funkcjonowania Międzynarodowego Trybunału Karnego w jego obecnym kształcie.

The main aims of this paper are: to present the evolution of international criminal justice as a response to war crimes, to present its current condition, and to characterize the International Criminal Court. Thorough analysis has been done, in particular, on the subsequent international tribunals and their normative foundations. Most of all, International Criminal Court has been carefully analyzed. Therefore, the process for its establishment, the procedure of the Statute of the International Criminal Court coming into force, as well as its essence and basic issues related to its functioning have been presented. Afterwards, the article discusses the basis for the Court's jurisdiction and its internal organization, too. The text discusses also the range of the jurisdiction of the International Criminal Court, execution of the judgments and the range of possible penalties. At the end, there was presented a critical evaluation of the functioning of the International Criminal Court in its current form.
