A position of an expert witness on the basis of the amended Code of Criminal Procedure

Artykuł jest próbą ukazania pozycji ustrojowej biegłego na gruncie obowiązujących przepisów procedury karnej. Omówione zostały także poszczególne zmiany Kodeksu postępowania karnego dotyczące prawa dowodowego wraz z próbą zwrócenia uwagi na najważniejsze wątpliwości związane z nowelizacją art. 167 k.p.k. oraz art. 393 § 3 k.p.k. Na gruncie znowelizowanych przepisów dopuszczalne będzie odczytywanie na rozprawie wszelkich dokumentów prywatnych. Tym samym ustawodawca dopuszcza wprowadzanie do postępowania opinii prywatnych (ekspertyz prywatnych), co też wymaga nowego spojrzenia na zagrożenia związane z dopuszczeniem tychże opinii na przebieg postępowania karnego.

The purpose of this article is to define a position of an expert witness on the basis of existing rules of the criminal procedure. The author also analyses individual amendments to the Code of Criminal Procedure concerning the law of evidence, with particular regard to the the important concerns that arise from the amendment of article 167 C.C.P. and article 393 § 3 C.C.P. On the basis of the amended regulations it will be acceptable to read any private document at the hearing. Thus, the legislator provides possibility to introduce private opinion (private expertise) to the conduct, which may become the source of new problems that require new perspective on the course of criminal proceedings.
