Legal aspects of Catalan secession

Artykuł porusza problematykę związaną z prawnymi uwarunkowaniami uzyskania przez Katalonię niepodległości oraz przybliża prawdopodobne skutki, jakie nastąpiłyby w wyniku realizacji takiego scenariusza. Autor stara się przytoczyć argumenty obu stron sporu: władz centralnych oraz władz katalońskich, konfrontując je z rzeczywistym stanem prawnym oraz z poglądami przedstawicieli doktryny. The paper discusses the problems connected with the legal conditions of obtaining the independence by Catalonia and envisages the probable effects that would occur as a result of such a scenario. The author attempts to cite the arguments of both parties to the dispute: the central authorities and the Catalan government, verifying them with the actual legal status and with the views of representatives of the doctrine. Moreover, the article comprehensively addresses many legal aspects, on the grounds of which arise doubts and disputes, particularly dealing with the matters concerning Spanish Constitutional Law, International Law and the related right to self-determination, as well as the Law of the European Union with regard to EU membership of the new political body. In addition, the study itself is enriched with essential in this case political backdrop that allows the reader to understand the motivations of both adversaries.
