The impact of the Landscape Act on precepts of criminal law in the broad sense

Artykuł odnosi się do zmian wprowadzonych przez ustawę z dnia 24 kwietnia 2015 r. o zmianie niektórych ustaw w związku ze wzmocnieniem narzędzi ochrony krajobrazu (Dz.U. poz. 774 ze zm.) w obszarze norm szeroko pojmowanego prawa karnego. Omówione w nim zostały przepisy, które w związku z wejściem w życie tejże ustawy zmieniły swoje brzmienie (art. 63a Kodeksu wykroczeń oraz art. 118 ustawy o ochronie zabytków i opiece nad zabytkami), bądź też zostały wprowadzone jako nowe regulacje (art. 63b Kodeksu wykroczeń). Autor w swej pracy rozważa zakres poszczególnych nowelizacji, ich charakter oraz skutki prawne, oceniając przy tym wpływ wejścia w życie ustawy krajobrazowej na życie obywateli z prawnokarnej perspektywy.

The present article refers to the changes introduced with the act of 24 April 2015 amending some acts on instruments strengthening of landscape preservation in a broad sense of Polish criminal law. It discusses provisions that were amended after the act came into effect (the art. 63a of Petty Offences Code and the art. 118 of the act on protection and conservation of heritage) or that were supplemented to the act as new regulations (the art. 63b of Petty Offences Code). Its author presents the scope of particular amendments, their nature, as well as their legal effects, evaluating the impact that the act in question has on citizens' lives from the perspective of penal law.
