Reform of the Open Pension Funds : constitutional issues

Przedmiotem artykułu jest problematyka związana z reformą Otwartych Funduszy Emerytalnych, która została przeprowadzona w 2013 r. Ze względu na fakt, iż zagadnienie to dotyczy zdecydowanej większości społeczeństwa, w tekście omówione zostaną społeczne, gospodarcze oraz konstytucyjne aspekty tejże reformy. W pierwszej kolejności wyjaśnione zostanie czym jest "ubezpieczenie społeczne", a także istota utworzenia "Otwartych Funduszy Emerytalnych". Następnie omówione zostaną podstawowe założenia przeprowadzonej reformy oraz główne zarzuty stawiane reformie OFE, dotyczące przede wszystkim niezgodności z Konstytucją RP. Przedstawiony zostanie także wyrok Trybunału Konstytucyjnego w tej sprawie, jego główne tezy, motywy oraz konsekwencje wydanego orzeczenia.

The subject matter of this article is the reform of the Open Pension Funds which was executed in the 2013. Due to the fact that the issue in question relates to the vast majority of the population in the text author will discuss the social, economic and constitutional aspects of this reform. First of all, the term "social security" as well as the essence of creating Open Pension Funds will be examined. Then the main principles of the reform and the main charges against the reform of the Open Pension Funds related primarily to non-compliance with the Constitution of the Republic of Poland will be discussed. The Constitutional Court's judgment in this case will be presented, its main thesis, as well as the motives and the consequences of the issued judgment.
