Sky killer or effective weapon? : the use of combat drones on asymmetrical battlefield from the perspective of humanitarian law and military tactics

Celem niniejszego artykułu jest analiza praktyk targeted killing oraz signature strikes, dokonywanych za pomocą bezzałogowych statków powietrznych (BSP). Przedmiotowe praktyki są jednym z najbardziej kontrowersyjnych środków używanych w walce z globalnym terroryzmem i stawiają szereg pytań natury celowościowej, moralnej jak i prawnej. Autor prezentuje politykę targeted killing oraz signature strikes na przykładzie krajów stosujących ją w sposób najbardziej zorganizowany - Stanów Zjednoczonych oraz Izraela, a następnie przybliża stojącą za nimi taktykę wojskową. Metodą case-study zaprezentowany został model przedmiotowych praktyk. Analizie poddano również uregulowania prawa humanitarnego i orzecznictwo międzynarodowe, celem weryfikacji dopuszczalności opisywanych praktyk oraz odpowiedzi na pytanie o alternatywne możliwości efektywnego wykorzystania dronów bojowych.

The article presents theses on targeted killing as an example of the use of UCAVs - Unmanned Combat Aerial Vehicles. Targeted killing is one of the most controversial tactics employed in the war on terrorism and it is a political, moral and legal problem. International humanitarian law permits the use of lethal force in only two cases, law enforcement and just war. This article presents the policy of targeted killings and signature strikes on the example of liberal regimes, such as United States and Israel. The author uses the case-study method to show how targeted killing and signature strikes are conducted. The paper analyzes case-law of international courts and regulations of the humanitarian law, and evaluates if the UCAVs of can be efficiently applied in modern asymmetric warfare.
