Preemption of agricultural real estate and forest land : the practice of the first months of the legislation

Wprowadzone w 2016 roku nowe prawa pierwokupu nieruchomości rolnych oraz gruntów leśnych spowodowały istotne zmiany w strukturze obrotu nieruchomościami w Polsce. Niniejszy artykuł będzie okazją do analizy przesłanek stosowania nowych przepisów, oceny charakteru nieruchomości podlegającym ograniczeniom oraz problemów pojawiającym się w praktyce obrotu gospodarczego. Odpowiedź na wątpliwości będzie dokonywać się na gruncie praktycznym zgodnie z dyrektywami wykładni celowościowej, co jest konieczne ze względu na niejednoznaczność obowiązujących przepisów.

Introduced in 2016 new laws emption of agricultural and forest land caused significant changes in the structure of real estate in Poland. This article will provide an opportunity to analyze the conditions for the application of new regulations, assess the nature of the property subject to restrictions and problems arising in the practice of economic activity. The answer to the questions will be made on the basis of practical accordance with the directives teleological interpretation, which is necessary due to the ambiguity of laws.
