Is the stable criminal trial possible? : reflections on the (next) changes to the Code of Criminal Procedure in the light of the Constitution

Zasada stabilności prawa jest jednym z kluczowych elementów składających się na twór, jakim jest demokratyczne państwo prawne. W stabilnym systemie prawnym kluczową rolę odgrywa niezmienny, uporządkowany proces karny. Artykuł odnosi się do ostatnich gruntownych nowelizacji kodeksu postępowania karnego, które dokonały zasadniczych zmian w modelu postępowania oraz w statusie jego uczestników. Rozważania dotyczą częstotliwości zmian w ustawie karnej procesowej oraz ich oceny w świetle Konstytucji RP. Analizie poddane zostały zarówno działania legislacyjne oraz ich niepożądane skutki, jak również możliwości zahamowania nieustannych zmian prawnych.

The principle of stability of law is one of the key elements of the democratic legal state. A stable, constant criminal proceedings play a key role in legal system. The article refers to the recent amendments of the Code of Criminal Procedure, which have made major changes in the model of proceedings and the status of its participants. Considerations apply to the frequency of changes in the criminal process and assess them in the light of the Constitution. The last changes were analysed on the basis of negative effects of the constant legislative action, but also highlighted were solutions of limitation those undesirable regulations.
