Legal aspects of the deregulation of prices in the Polish gas market

Obowiązujące w Polsce regulacje zakładają konieczność utworzenia i umotywowania przez przedsiębiorstwa energetyczne, a następnie przedstawienia do zatwierdzenia Prezesowi Urzędu Regulacji Energetyki, stawek opłat za dostawy gazu. Trybunał Sprawiedliwości Unii Europejskiej uznał ten stan rzeczy za niezgodny z prawem Unii, co spowodowało, iż Polska od kilku lat przygotowuje rynek gazu na mającą rychło nastąpić deregulację. Najważniejszym elementem, definitywnie przesądzającym o kolejnym kroku w kierunku liberalizacji rynku - uwolnieniu cen gazu, jest przyjęcie dnia 30 listopada 2016 r. przez Sejm projektu ustawy o zmianie ustawy - Prawo energetyczne, które wprowadza harmonogram zwolnienia z obowiązku przedkładania Prezesowi URE taryf do zatwierdzenia przez przedsiębiorstwa energetyczne, czyli tzw. detaryfikacji. Niniejszy artykuł ma na celu przedstawienie najważniejszych działań podjętych w celu detaryfikacji na polskim rynku gazu i założeń wskazanej ustawy, a także jej ocenę.

Applicable in Poland regulations establish the need to create and motivate by energy companies and then submitted for approval to the President of the Energy Regulatory Office fees for gas supplies. The Court of Justice of the European Union recognized this state of affairs is incompatible with European Union law. Therefore, the Polish market is preparing for its deregulation. The most important element, definitely conclusive about the next step towards the liberalization of the market - the release of gas prices, is the adoption on 30 November 2016. by the Parliament a draft law amending the Act - Energy Law, which introduces a timetable for exemption from the obligation to submit to the President of Energy Regulatory Office tariffs for approval by the company energy. This article aims to present the most important measures taken to polish gas market deregulation and assumptions of the Law, as well as its evaluation.
