The course of the conclave on the grounds of the John Paul II's Universi Dominici Gregis apostolic constitution of 22 February 1996

Wybór Biskupa Rzymu stanowi doniosłe wydarzenie dla Kościoła katolickiego, ponieważ osoba następcy świętego Piotra ma szczególne znaczenie dla przyszłości wspólnoty wiernych. Najistotniejszą rolę w uregulowanej prawnie procedurze wyboru pełni konstytucja apostolska Universi Dominici Gregis, promulgowana przez Jana Pawła II w dniu 22 lutego 1996 r., zastępująca poprzednio obowiązującą konstytucję apostolską Pawła VI Romano Pontifici eligendo z 1975 r. Kreuje ona instytucję konklawe, będącą fundamentem stosownych przepisów. Konstytucja apostolska determinuje nie tylko formę wyboru, czynne i bierne prawo wyborcze, ale również takie aspekty jak m.in przygotowanie do głosowania, tajemnicę konklawe i skutki jej złamania. Normuje również niektóre liturgiczne aspekty wyboru papieża. Artykuł uwzględnia elementy historyczno-prawne wyboru głowy Kościoła katolickiego. Zostały one zestawione z obecną regulacją, w celu ukazania zmian, które ukształtowały obowiązującą procedurę elekcji.

The election of the Bishop of Rome poses a great event for the Catholic Church because of the fact that St. Peter's successor is of the particular importance for the future of the community of worshippers. The most significant role in the legally regulated procedure is played by the apostolic constitution Universi Dominici Gregis promulgated by John Paul II on 22nd February 1996, superseded Paul VI's Romano Pontifici eligendo apostolic constitution of 1975. It creates the conclave institution, posing the basis of the regulations. The apostolic constitution determines not only the form of the election, the right to vote and the right to stand for election, but also such aspects as inter alia preparing for voting, secrecy of conclave and implications of its breaking. It also regulates some liturgical aspects of the election. The article includes historical-legal points of the election of the head of the Catholic Church. They have been correlated with the current regulation in order to present changes which formed effective procedure of the election.
