Normative features in a semantic and institutional approach

Niniejszy artykuł poświęcony jest zagadnieniu znamion normatywnych. Przyjętym celem jest naświetlenie problemów wyłaniających się przy ich analizie. Podjęto między innymi próbę wyjaśnienia spornych zagadnień dotyczących ujmowania wskazanych znamion jako ocennych albo deskryptywnych. Szerokie rozważania dotyczą instytucjonalnego pojmowania znamion, co wiąże się z wyróżnieniem w ich treści reguł konstytutywnych, tj. reguł, które nadają psychofizycznej rzeczywistości nowego, nieznanego poza prawem, sensu. Powyższe zagadnienia starano się omawiać w odwołaniu do przedstawicieli doktryny prawa karnego, jak również teorii prawa i teorii języka.

The paper is dedicated to the issue of normative features. The adopted objective of the article is to cast light on problems that arise in an analysis of normative features. Among other things, the article attempts to clarify contentious issues related to approaching normative features as evaluative or descriptive. There are broad considerations that pertain to the institutional understanding of these features; these considerations are connected with distinguishing constitutive rules within their content, i.e. rules that bestow the psychophysical reality with a new sense that is unknown outside of the law. A discussion of the aforementioned issues was attempted in reference to representatives of the doctrine of criminal law, as well as to the theory of law and the theory of language.
