The problem of patentability and outside patent protection of business methods in Poland and in the world in the light of the TRIPS agreement

Celem artykułu jest wykazanie problematyki ochrony patentowej i poza patentowej wynalazków sensu largo na przykładzie metod biznesowych. W pierwszej części artykułu omówione zostały związane z możliwością ochrony patentowej metod biznesowych. Część ta zawiera próbę definicji wynalazku oraz nakreślenie włączeń spod ochrony patentowej. Zawiera ona również próbę zdefiniowania metod biznesowych jak i analizę możliwości ich ochrony patentem w regulacjach międzynarodowych. W drugiej części artykułu omówione sposoby ochrony metod biznesowych środkami poza patentowymi, ze szczególnym uwzględnieniem know-how, stosunków pracowniczych oraz tajemnicy handlowej. W części tej wskazane zostały konstytutywne cechy tajemnicy handlowej oraz know-how. Zaznaczone zostały również cechy odróżniające oba przedmioty ochrony faktycznej.

The aim of this article is to demonstrate the problems of patent protection and outside the patentability protection of inventions in the broad sense on the example of business methods. In the first part of the article discusses the possibility of related patent business methods. This part contains the definition of the invention and an attempt to outline starts from patentability. It also includes an attempt to define business methods and analysis capabilities of their patent protection in international regulations. In the second part of the article discusses ways to protect business methods patent agents outside, with particular emphasis on the know-how, employee relations and trade secrets. In this section it has been indicated constitutive features of trade secrets and know-how. They identify also the distinguishing features of both actual objects of protection.
