The need for separation of investigation procedure in separate proceedings in cases within the subject-matter and scope of labour law

Przedmiotem artykułu jest analiza wzajemnej relacji art. 468 k.p.c., dotyczącego czynności wyjaśniających w postępowaniu odrębnym w sprawach z zakresu prawa pracy, i art. 130 § 1, 212 § 1, 223 § 1 k.p.c. w postępowaniu zwykłym. Zasadniczo regulacje te zdają się spełniać te same cele. Szczegółowa analiza tego zagadnienia pozwala na ocenę, czy regulacje te są w stosunku do siebie substytucyjne i zasadna byłaby rezygnacja z czynności wyjaśniających.

The purpose of this article is to analyze the interaction between Art. 468 k.p.c. concerning investigation procedure in separate Proceedings in Cases within the Subject-Matter and Scope of Labour Law and Art. 130 § 1, 212 § 1, 223 § 1 k.p.c. in ordinary proceedings. Basically, these regulations seem to be aimed at achieving the same goals. A detailed analysis of this issue allows to assess whether these regulations are substitute to each other and therefore if the removal of such investigation procedure would be justified.
