The role of the principle of proportionality in the interpretation of regulations of the substantive criminal law

Zasada proporcjonalności dotyczy ingerencji w prawa i wolności jednostki we wszystkich gałęziach prawnych. Mimo to szczególnym zainteresowaniem cieszą się jej związki z prawem karnym, przy czym kwestią wyjątkowo sporną jest zakres jej zastosowania w procesie wykładni przepisów prawa karnego materialnego. Precyzyjne określenie przesłanek zastosowania zasady proporcjonalności nastręcza wiele problemów i wymaga przytoczenia poglądów dotyczących treści tej zasady, wskazania podstawowych problemów z tym związanych i próby przeniesienia tego na grunt wykładni przepisów prawnokarnych. Celem tekstu jest odniesienie się do prezentowanych dotychczas poglądów na temat znaczenia zasady proporcjonalności w prawie karnym i przedstawienie własnego stanowiska. Kluczową perspektywę dla sformułowania odmiennego poglądu stanowi zasada podziału i równowagi władzy wraz z dookreślającymi ją regulacjami konstytucyjnymi.

The principle of proportionality is related to limitation upon the exercise of constitutional freedoms and rights in many different areas of law. Despite this, the principle of proportionality is known as very important especially in the criminal law. It is also very contentious issue how wide is range of this principle in the process of interpretation of substantive criminal law. Precise definition of the premises of the principle of proportionality brings a lot of problems so it requires an analysis of views on the content of this principle and identify the most important problems. The objective of the text is a reference to the previously presented views on the importance of the principle of proportionality in criminal law and present own view. The key perspective is the principle of separation of and balance between powers and constitutional regulations related to this principle.
