Rules in dubio pro reo and in dubio pro duriore in Polish penal procedure

Niniejszy artykuł odnosi się do dwóch reguł prawno-procesowych in dubio pro reo i in dubio duriore. Na wstępie opisano perspektywę teoretyczną w odniesieniu do domniemania niewinności, wykorzystując przy tym pojęcia prawnicze takie jak reguła, zasada, logiczna konsekwencja norm oraz regulacje konstytucyjnoprawne. W pierwszej części, zaprezentowano i opisano dwie tezy dla in dubio pro reo: 1. i. d. p. r. dla postępowania sądowego jest regułą rozstrzygania, 2. i. d. p. r. dla postępowania przygotowawczego jest onus probandi. W drugiej części, biorąc pod uwagę konieczność zamknięcia postępowania przygotowawczego, zaproponowano in dubio pro duriore jako regułę rozstrzygania.

This paper is about two rules in dubio pro reo and in dubio pro duriore in penal procedure. In introduction it was described theoretical perspective with regard to presumed innocent, used then the legal concepts as a rule, a principle, a logical consequence by norms and the constitutional regulations. In the first instance, there were presented and described two theses about in dubio pro reo: 1. i. d. p. r. for court action is a decisive rule, 2. i. d. p. r. for a preparatory proceedings is onus probandi. In the second instance, it was proposed taking into consideration a necessity of a closure of preparatory proceedings, in dubio pro duriore as a decisive rule.
