The problem of the relation of being and obligations and the concept of human rights

Artykuł dotyczy relacji sfer bytu i powinności w aspekcie koncepcji praw człowieka. Analizowana jest tzw. Gilotyna Hume'a i problemy wynikające z wnioskowań na jej temat, mające na celu uzasadnienie praw człowieka. Ukazane są różne interpretacje Hume'a wraz z próbą znalezienia najbardziej odpowiedniej. Dalej autor przedstawia różnorakie wizje ustalenia filozoficznoprawnych podstaw praw człowieka oraz problemy z nimi związane. Rozważane są pojęcia godności człowieka oraz natury ludzkiej. Rozpatrywane są konstytucyjne oraz prawnomiędzynarodowe fundamenty ich obowiązywania. Rozważania na temat praw człowieka zostają zanalizowane przez pryzmat Gilotyny Hume'a. Próbą wyjścia z rodzących się dylematów jest naturalizacja metodologiczna stawianych pytań i znalezienie odpowiedzi w dokonaniach psychologii ewolucyjnej. Autor wykorzystuje myśl ewolucyjnej filozofii prawa, by ukazać naturalistyczne fundamenty natury człowieka oraz prawa, po czym skupia się na ukazaniu prawidłowości istnienia praw człowieka, pomimo niedostatków w logicznym ich uzasadnieniu.

The article concerns relations of being and ought spheres in the point of the concept ofhuman rights. There is analyzed Hume's Guillotine and problems which it implicates to reasoning aiming in the justification of human rights. Different Hume's interpretations are demonstrated along with an attempt of seeking the most appropriate. Next, the author presents various accounts for jurisprudential roots of human rights and problems involved. Concepts of human dignity and human nature are considered. There are discussed constitutional and international grounds of their validity. Thoughts concerning human rights are analyzed in the light of Hume’s Guillotine. An attempt to solve arising dilemmas is to naturalize methodologically questions that are posed and to seek the answer in the knowledge of evolutionary psychology. The author takes advantage of evolutionary philosophy of law in order to demonstrate naturalistic fundaments of human nature and law; then, he focuses on presenting correctness of human rights existence, despite the lack of their logical justification validity.
