Conventional and constitutional standard of a fair trial in the context of the habeas corpus proceeding in the light of the provisions of the Code of Criminal Procedure

Opracowanie zawiera analizę oraz ocenę uregulowań polskiej procedury karnej w zakresie dostępu podejrzanego i jego obrońcy do akt w postępowaniu w przedmiocie tymczasowego aresztowania. Rozważaniom zostały poddane uregulowania obowiązujące na przestrzeni ostatnich lat w kontekście ich zgodności ze standardami nakreślonymi przez Europejski Trybunał Praw Człowieka oraz Trybunał Konstytucyjny. Opracowanie zostało uzupełnione o analizę kształtu niniejszego zagadnienia w świetle najnowszego projektu nowelizacji procedury karnej.

The study contains an analysis and assessment of the Polish criminal procedure rules with regard to the suspect’s and his defense counsel’s access to the records in proceedings in pre-trial detention. Considerations have been subjected to regulations in force in recent years in terms of their compliance with the standards outlined by the European Court of Human Rights and the Constitutional Court. The study was supplemented by an analysis of the shape of this issue in the light of the recent draft amendment to the Code of Criminal Procedure.
