Relationship between "author's supervision" institutions under Polish copyright law and construction law

Artykuł charakteryzuje występujące na gruncie dwóch ustaw polskich - prawa autorskiego oraz prawa budowlanego - instytucje nadzoru autorskiego oraz zestawia je ze sobą, odnosząc rozważania przede wszystkim do utworów architektonicznych. Zdaniem autora instytucje te wyraźnie się różnią, co w świetle ich identycznego nazewnictwa może rodzić problemy teoretyczne i praktyczne. Różnice zidentyfikowano na trzech płaszczyznach. Po pierwsze, przedmiotowy zakres stosowania przepisów o nadzorze autorskim jest nieco odmienny dla każdej z ustaw. Po drugie, osobą uprawnioną do przeprowadzania nadzoru autorskiego na podstawie prawa autorskiego jest twórca, zaś na podstawie prawa budowlanego - projektant. Podmioty te nie zawsze mogą być utożsamiane. Po trzecie, odmienny jest charakter prawny obu omawianych instytucji i ich cel. Możliwe do zaobserwowania podobieństwa między obiema instytucjami nie pozwalają na ich utożsamianie i nie uchylają ujemnej oceny zastosowania wobec nich identycznego nazewnictwa.

The article provides for a description of and comparison between two institutions named "author's supervision" as featured in statutes governing Polish copyright law and construction law. Particularly, supervision over works of architecture is analysed. The author believes that the said institutions differ significantly which, considering their identical naming, could lead to a number of problems, both theoretical and practical. Differences were identified in three aspects. Firstly, the scope of application of the provisions on author's supervision is different under each of the aforementioned statutes. Secondly, under copyright law, author's supervision may only be performed by the actual author of the work, while under construction law it is the "designer" (who may or may not be the actual author of the project) who should perform the supervision. Thirdly, the purpose of both institutions and their legal status are found to be different. Any observable similarities between the institutions subject to analysis are insufficient to consider them uniform and in no way affect criticism of their identical naming.
