The issue of the legality of research on the content of alcohol in the body to the participants in road traffics : de lege lata status and de lege ferenda postulates

Artykuł przedstawia problematykę legalności badań na zawartość alkoholu w organizmie wobec uczestników ruchu drogowego. Autor podejmuje rozważania rozdzielając problematykę związaną z prewencyjnymi kontrolami trzeźwości oraz badaniami na zawartość alkoholu sprawców przestępstw i wykroczeń. Omówione zostają także podstawowe środki ochrony prawnej przysługujące kontrolowanym uczestnikom ruchu drogowego. Celem publikacji jest ukazanie nie tylko aspektów teoretycznych związanych z aktualnie obowiązującymi przepisami, lecz również przedstawienie funkcjonowania tych przepisów w praktyce. Praca dotyka wielu gałęzi prawa i osadzona jest wielopłaszczyznowo - przede wszystkim w normach prawa administracyjnego, karno-administracyjnego (prawa wykroczeń) oraz prawa karnego sensu stricto, w mniejszym zakresie także prawa cywilnego i prawa konstytucyjnego. Autor kończy swoją analizę, dokonując reasumpcji stanu de lege lata oraz postulując własne propozycje zmian w aktualnie obowiązujących przepisach.

The article presents the issue of the legality of research on the content of alcohol in the body to the participants in road traffics. The author takes considerations separating the issues related to the preventive controls of sobriety and the controls against perpetrators of crimes and offenses. There are also discussed primary means of legal protection which are vested to the controlled road traffic participants. The aim of the publication is to show not only the theoretical aspects related to the current regulations, but also to present the functioning of these regulations in practice. This scientific work touches many branches of law and is mounted on multiple levels - primarily in the norms of administrative law, offence law and criminal law, to a lesser extent - also in the regulations of civil and constitutional law. The author concludes his analysis by making the repetition of the state de lege lata and postulating his own proposals for changes in the current legislation.
