Creative Commons licenses : reception in Polish law and their application

Celem artykułu jest refleksja nad recepcją w polskim prawie licencji Creative Commons. W artykule zostaną przedstawione podstawowe założenia tych licencji. Refleksji zostanie poddany charakter prawny licencji. Wskazane zostaną najważniejsze kwestie problematyczne związane z recepcją licencji do polskiego porządku prawnego, tj. obowiązywanie na czas nieoznaczony, czy obowiązywanie na terytorium całego świata. W szczególności zbadana zostanie kwestia sądu właściwego w przypadku sporu wynikającego z naruszenia treści licencji. Dodatkowo zaprezentowane zostaną przykładowe spory, które toczyły się w USA, Holandii, Izraelu, Hiszpanii i Belgii związane z naruszeniem licencji Creative Commons. Poruszona zostanie również kwestia funkcjonowania domeny publicznej i oświadczenia autora o zrzeczeniu się praw w polskim prawie.

The aim of this article is to reflect on the reception of Creative Common's license in polish law. The basic assumption of those licenses would be present. Reflection about the legal nature od license would be a subject of the article. The most problematic issues related to the reception of the licenses to the polish legal system would be presented, such as the validity of indeterminate duration or the validity of the territory around the world. In particular, a matter of a court having jurisdiction in the event of a dispute arising out of a breach of the licenses will be examined. In addition, examples of disputes, which took place in the United States, the Netherlands, Israel, Spain and Belgium related to the violation of the Creative Commons licenses will be presented. The subject of the article would be also the issue of the functioning of the public domain and the author’s statement of waiving all of he or she Copyright and Related Rights in polish Copyright Law.
