| abstract in Polish: | Wszystkie zadania samorządu terytorialnego klasyfikowane są jako zadania publiczne. Podobnie jednak jak nie istnieje jedna, niezmienna pula zadań publicznych, tak nie ma też zadań publicznych nieodzownie i raz na zawsze przypisanych samorządowi. Mimo to powszechnie uznaje się, iż „samorząd zadaniami stoi”. Taki stan rzeczy skłaniać musi do refleksji nad prawidłowością określania niektórych zadań jako zadania samorządu, o ich naturę oraz o ich rozmiar kwantytatywny i kwalifikatywny. Zwłaszcza w korelacji z takimi pojęciami jak interes publiczny, sfera użyteczności publicznej oraz dobro (interes)wspólnoty samorządowej. Celem niniejszego artykułu nie jest jednak zbudowanie nowej „teorii zadań samorządu terytorialnego”, a jedynie wskazanie, iż w świetle zmian cywilizacyjnych i kulturowych niezbędny jest dyskurs zarówno nad katalogiem, jak naturą i charakterem zadań samorządu terytorialnego, gdyż samozadowolenie ustawodawcy i doktryny z przyjętych w tym względzie dysfunkcjonalnych rozwiązań jedynie utrwala istniejące problemy, ugruntowuje indolencję reformatorską w sferze publicznej a nawet może przyczynić się o podważenia (jeśli nie zaprzepaszczenia) idei odbudowy samorządu terytorialnego. |
| abstract in English: | All tasks of territorial self-government are classified as public tasks. However, just as there is no invariable pool of public tasks, there are no public tasks that are imperatively, once and for all assigned to the local authority. Even so, it is generally acknowledged that "the local authority has tasks." This state of affairs must lead to reflection on the correctness of determining certain tasks as local authority tasks, as well as their nature and their quantitative and qualitative dimension. Especially in correlation with such concepts as public interest, the sphere of public utilities and the good (interest) of the local community. However, the objective of this article is not to build a new "theory of the local authority tasks", but to indicate that, in the light of civilizational and cultural changes, a discourse is required on both the list, the nature an the character of the tasks of the local authority, because complacency of the lawmakers and the legal doctrine in the dysfunctional solutions adopted in tis respect reinforces existing problems, consolidates the reformatory indolence in the public sphere and can even contribute to undermining (or wasting) the idea of reconstruction of the local authority. |
