Use of public order clause in the matters concerning entering into marriage : selected issues

The text discusses selected issues related to the possible application of public policy clause in matters relating to entering into marriage, by a Polish court. The introductory section describes the public policy clause in general and the main principles for its application. Since its use is possible only if the foreign law designated as applicable is incontrary to the fundamental principles of the Polish legal system, the main part of the work is an attempt to answer the question which principles of the Polish law concering marriage is of such nature. The paper discusses the principle of freedom of marriage, the principle of monogamy and the principle of social value of marriage. For each of the above principles there have been presented cases, in which the use of foreign law may be contradictory.
