FICTIONAL CHARACTERS AS KNOWLEDGE COMMONS: Intellectual Property Laws that help or harm design principles present in robust and long-enduring common-pool institutions

master
My research is a policy review of intellectual property law applying Elinor Ostrom’s theory of knowledge as commons. Guided by the Institutional Analysis and Development Framework and the design principles that are found in robust and long-enduring common-pool resource institutions, the intangible resource of fictional characters, as protected under different IP regimes, is transformed into a lens of the changes in intellectual property law. It assesses intellectual property law applicable to fictional characters as helpful or harmful to the design principles in common-pool institutions. The intersection of commons research and IP laws on fictional characters reveals insights about knowledge as commons research, intellectual property law policy, and the need for a holistic and systematic approach in international intellectual property law.pl
