"The appeal is in force…" : repulsion against Hans Kelsen's concept of normative in the legislation during the state of epidemic

W trakcie stanu epidemii w Polsce prawodawca wprowadził - za pomocą rozporządzeń - ograniczenia, zakazy i nakazy, które szeroko ingerowały w prawa i wolności obywatelskie. Wielu obywateli znalazło się konflikcie z organami starającymi się wyegzekwować powyższe normy. Doprowadziło to konfrontacji działań władzy wykonawczej i ustawodawczej z władzą sądowniczą. Na tym gruncie ożywił się w judykaturze i doktrynie, istniejący od I połowy XX w., spór między zwolennikami normatywizmu i decyzjonizmu.

During the state of epidemic in Poland, the legislator introduced - by ordinances - restrictions, bans and orders that widely interfered with civil rights and freedoms. Many citizens were in conflict with the authorities trying to enforce the regulations. This led to a confrontation between the judiciary and actions of the executive and legislative powers. In connection with that, in judicature and doctrine revived the dispute between the supporters of normativism and decisionism, which was existing since the first half of the 20th century.
