Celem artykułu jest przedstawienie roli Wyszehradzkiego Instytutu Patentowego w międzynarodowym systemie ochrony patentowej opartym na Układzie o współpracy patentowej podpisanym w Waszyngtonie w 1970 r. (tzw. system PCT), stanowiącym jeden z głównych mechanizmów uzyskiwania ochrony wynalazku poza granicami kraju wynalazcy. Omówione zostają poszczególne funkcje i kompetencje Instytutu. Ocenie zostaje poddana skuteczność i przydatność Instytutu, ze szczególnym uwzględnieniem korzyści, jakie płyną z jego działalności dla podmiotów ubiegających się o ochronę patentową w państwach Europy Środkowo-Wschodniej, jak też wskazaniem, czy i w jakim stopniu Instytut przyczynia się do rozwiązania problemów, z jakimi boryka się system PCT. Artykuł stanowi wkład w dyskusję na temat działań podejmowanych w celu wspierania innowacji, zwiększenia konkurencyjności i promowania wzrostu gospodarczego w Europie Środkowej.

The aim of the article is to present the role of the Visegrad Patent Institute in the international patent protection system based on the Patent Cooperation Treaty signed in Washington in 1970 (i.e. PCT system), which is one of the main mechanisms for obtaining protection of an invention outside the country of the inventor. Individual functions and competences of the Institute are discussed. The effectiveness and usefulness of the Institute are assessed, with particular emphasis on the benefi ts of its activities for entities applying for patent protection in Central and Eastern Europe, as well as an indication of whether and to what extent the Institute contributes to solving the problems faced by the PCT system. The article contributes to the discussion on measures taken to support innovation, increase competitiveness and promote economic growth in Central Europe.
