Deepface technology: definition, tendencies, regulatory landscape

Głównym celem pracy jest przedstawienie techniki deepfake i jej zastosowań w technicznych i socjalnych aspektach oraz ocena poziomu gotowości systemu prawnego na obszarze polskim oraz europejskim ze strony zagadnień prawno-autorskich, ochrony czci, danych osobowych oraz proponowanej regulacji sztucznej inteligencji. Po badaniu istniejących regulacji, projektów rozporządzeń oraz decyzji sądowych obejmujących problematykę sztucznej inteligencji oraz miejsce tej technologii w zakresie praw własności intelektualnej, zostały ujawnione odrębne luki prawne, których powodem jest między innymi rozwój i utowarowienie technologii deepfake oraz brak głębszego zapoznania się z nią. Przeciwdziałanie negatywnym skutkom związanym z deepfake wymaga zarówno podejścia zapobiegawczego, jak i reaktywnego, mającego na celu unikanie niepożądanych zastosowań technologii deepfake i przeciwdziałanie im.

The main objective of the work is to present the deepfake technology and its applications in technical and social aspects and to assess the level of readiness of the legal system in the polish and European legal landscape from the point of view of such issues as copyright, protection of reputation, personal data and artificial intelligence. After studying existing regulations, draft regulations, and court decisions covering the issue of artificial intelligence and the place of this technology in the field of intellectual property rights, separate gaps have been revealed, the reason for which is, among other things, rapid development and commodification of deepfake technology and the lack of a deeper understanding of it. Addressing the negative effects of deepfake requires both a preventative and a reactive approach to avoid and counter the undesirable uses of deepfake technology.
