A medical treatment without a patient's consent (Article 192 of the Polish Penal Code)

Praca została poświęcona wyjaśnieniu zagadnienia odpowiedzialności karnej za wykonanie zabiegu leczniczego bez zgody pacjenta na gruncie art. 192 k.k.. Pomimo prostej konstrukcji przepisu problematyka występku z art. 192 k.k. jest złożona i wielowątkowa. Niniejsza praca zawiera analizę użytych przez ustawodawcę terminów „zabiegu leczniczego” oraz „pacjenta”. W pracy przeprowadzono również kompleksowe studium dotyczące instytucji zgody, a także omówiono problematykę podmiotu przestępstwa z art. 192 k.k. – czy jest to przestępstwo o charakterze indywidualnym, czy powszechnym. W ostatnim rozdziale zawarto dwa badania ankietowe dotyczące omawianej tematyki. W aneksie znalazł się wywiad z dr n. med. Jerzym Uzarem dotyczący problematyki uzyskiwania zgody pacjenta.

The thesis is devoted to clarify the issue of criminal liability for performing a medical procedure without a patient's consent under Art. 192 of the Polish Penal Code. The issue of misdemeanor under Art. 192 of the Penal Code, despite the simple structure of the provision, is complex and multi-threaded. This thesis contains an analysis of the terms "medical treatment" and "patient" used by the legislator. The thesis also includes a comprehensive study of the institution of consent and discusses the subject of the crime under Art. 192 of the Penal Code - whether it is an individual or a common crime. The last chapter contains two questionnaire surveys on the topic in question. The appendix includes an interview with Jerzy Uzar MD on the issue of obtaining patient consent.
