Human and civil rights and freedoms and the institution of the Ombudsman in the Constitution of the Republic of Poland

Niniejsza praca licencjacka "Prawa i wolności człowieka i obywatela oraz instytucja Rzecznika Praw Obywatelskich w Konstytucji Rzeczypospolitej Polskiej porusza kwestię ochrony praw i wolności z uwzględnieniem podziału pomiędzy obywatelami a ludźmi znajdującymi się na terytorium Rzeczypospolitej. W tytule pracy zawarta została Instytucja Rzecznika Praw Obywatelskich, jako konstytucyjny organ stojący na straży wolności praw i człowieka i obywatela. Praca składa się ze wstępu oraz trzech rozdziałów. Pierwszy z nich "Rozwój praw człowiek" wprowadza historyczne tło, dzięki któremu łatwiej zrozumieć obecny kształt i zakres działania prawa. Drugi rozdział "Prawa i wolności w Konstytucji Rzeczypospolitej z dnia 2 kwietnia 1997 roku" dotyczy bezpośrednio praw i wolności oraz ich ochronie, zawartych w ustawie zasadniczej. Ostatni rozdział "Instytucja Rzecznika Praw Obywatelskich" również wprowadza tło historyczne, jednocześnie opisując organ Ombudsmana oraz jego działania w ujęciu konstytucyjnym. Celem pracy licencjackiej jest wskazanie bardzo szerokiego zakresu praw i wolności człowieka i obywatela w świetle Konstytucji RP oraz omówienie instytucji Rzecznika Praw Obywatelskich. Zakres pracy w znakomitej mierze opiera się na artykułach Konstytucji Rzeczypospolitej z 2 kwietnia 1997 roku, jednak aby dokonać dogłębnej analizy, w pracy pojawia się wiele odwołań do wyroków Trybunału Konstytucyjnego oraz ustaw, z wykorzystaniem stron rządowych. Szczegółowo zostały opisane kategorię praw człowieka oraz źródła i rodzaje wolności praw człowieka i obywatela w Konstytucji Rzeczypospolitej.

The Bachelor's thesis "Human and Citizen Rights and Freedoms and the Institution of the Ombudsman in the Constitution of the Republic of Poland addresses the protection of rights and freedoms with regard to the division between citizens and people located on the territory of the Republic of Poland. The work title includes the Institution of the Ombudsman, as a constitutional body guarding freedom of rights and human and civil rights. The work consists of an introduction and three chapters. The first of these, 'The Development of Human Rights, introduces the historical background through which it is easier to understand the current shape and scope of the law. The second chapter 'Rights and Freedoms in the Constitution of the Republic of 2 April 1997' deals directly with the rights and freedoms and their protection contained in the Basic Law. The last chapter "The institution of the Ombudsman" also introduces the historical background, while describing the Ombudsman body and its activities in constitutional terms. The Bachelor's thesis aims to indicate the very broad scope of human and civil rights and freedoms in the light of the Constitution of the Republic of Poland and to discuss the institution of the Ombudsman. The scope of the thesis is based to an excellent extent on the articles of the Constitution of the Republic of Poland of 2 April 1997, but in order to make an in-depth analysis, the thesis makes many references to judgments of the Constitutional Tribunal and laws. The category of human rights and the sources and types of freedom of human and civil rights in the Constitution of the Republic are described in detail.
