Criminal and psychological aspects of grooming and pedophile hunters’ activity

Przedmiotem niniejszej pracy magisterskiej jest próba scharakteryzowania zjawiska groomingu na płaszczyźnie prawnej oraz psychologicznej. Autorka pracy opisała zmiany jakie zaszły w postrzeganiu pedofilii na przestrzeni lat w ujęciu psychiatrycznym i psychologicznym wraz z uwzględnieniem wpływu nowych technologii komputerowych na wystąpienie cyberpedofilii. W dalszej części pracy przedstawione zostały regulacje międzynarodowe, stanowiące ratio legis penalizacji groomingu w systemie polskiego prawa oraz mające istotne znaczenie dla wzmocnienia ochrony małoletnich użytkowników sieci internetowej. Następnie analizie zostały poddane prace legislacyjne, których celem była zmiana polskiej ustawy karnej i wprowadzenie karalności groomingu oraz dokonano omówienia konstrukcji tego nowego typu czynu zabronionego. Autorka zwróciła również uwagę na istniejący w doktrynie problem określenia charakteru prawnego przestępstwa groomingu i podjęła próbę oceny tego zagadnienia na podstawie zaprezentowanych w literaturze stanowisk. Ponadto opisana została działalność grup zwanych łowcami pedofili, których celem jest powstrzymanie cyberprzestępczości seksualnej popełnianej na szkodę małoletnich. Każdy etap aktywności tych grup został poddany szczegółowej analizie prawnej. W ostatniej części przedstawione zostały wnioski wywiedzione z rozważań ujętych w niniejszej pracy magisterskiej.

The subject of this thesis is an attempt to characterize the phenomenon of grooming on the legal and psychological level. The author described the changes that have taken place in the perception of pedophilia over the years from the psychiatric and psychological viewpoint, including the impact of new computer technologies on the occurrence of cyber-pedophilia. In the further part of the dissertation, there were presented international regulations, which are constituting ratio legis of penalization of grooming in the Polish system of law and which are essential for the strengthening of the protection of minors users of the Internet. Then, legislative proposals to amend the Polish Penal Law and criminalise grooming has been analyzed and the construction of this new type of criminal act has been discussed. The author also drew attention to the problem of determining the legal nature of the crime of grooming and attempted to assess this issue on the basis of reviews presented in the literature. Moreover, the activity of groups called pedophile hunters, whose aim is to stop sexual cybercrime committed against minors, has been described. Each stage of activity of these groups has been subjected to a detailed legal analysis. The last part presents the conclusions drawn from the considerations included in this thesis.
