Abstract in English

In the article, the issue of abusiveness of clauses relating to the conversion of zlotys into currency and vice versa is analyzed. Such clauses are contained in indexed and denominated loan agreements. The author analyzes the impact of such clauses on the validity of the contract. It is considered whether a court has powers to declare a loan agreement that contains provisions violating Art. 3851 of the Civil Code and the provisions of Directive 93/13 null and void. Reference is made in this respect not only to the views expressed in the literature on the subject but also in judicial decisions and a judgment of the CJEU referring directly to the Polish borrower's case. The text also indicates possible other legal bases allowing for the recognition of a denominated and indexed credit agreement with indexation clauses as invalid.
