Abstract in English
The purpose of the article is to consider the liability of the State Treasury for damage caused by actions of public authorities in a situation where none of the emergencies provided for in the Constitution of the Republic of Poland has been introduced, but damage could be caused by restrictions, orders, and prohibitions imposed in connection with the SARS-CoV-2 pandemic. The study describes permissible modes of indemnification, analyses the basis for a possible claim for damages, takes into consideration the latest case law, and refers to the impact of aid received under the so-called governmental anti-crisis shields on the amount of compensation due.
