W ramach artykułu Autor rozważa relacje prawne pomiędzy instytucją sygnalisty a instytucją funkcjonariusza publicznego w kontekście wspólnych zadań i ratio legis uwzględniając różnice obu podmiotów. Autor stawia tezę wedle której sygnalista posiada cechy niezbędne do zakwalifikowania tej instytucji do podmiotów z zakresu prawa publicznego. Ponadto Autor implementuję w ramach swojej argumentacji pojęcie władzy publicznej jako przymiotu, w który wyposażony jest sygnalista.

The author considers the legal relationship between the institution of a whistleblower and the institution of a public official in the context of common tasks and ratio legis, taking into account the differences between the two entities. The author argues that the whistleblower has the necessary characteristics to qualify this institution as a public law entity. In his argument the author also implements the concept of public power as an attribute with which the whistleblower is equipped.
