Celem pracy jest zbadanie rzymskiej instytucji crimen expilatae hereditatis, a także przepisów dotyczących spadku nieobjętego w prawie polskim. Praca składa się z trzech rozdziałów. Dwa pierwsze opierają się na źródłach prawa rzymskiego i dotyczą crimen expilatae hereditatis, jego genezy, cech i postępowania w sprawie tego przestępstwa. Trzeci rozdział dotyczy spadku nieobjętego w prawie polskim uregulowanego w kodeksie postępowania cywilnego oraz orzecznictwie i komentarzach.

The aim of this thesis is to analyze the Roman institution of crimen expilatae heretiatis and the regulations which refer to a not assumed inheritance in Polish law. The thesis contains of three chapters. The first two base on sources of Roman law and concern crimen expilatae hereditatis, its genesis, characteristics and proceeding for this crime. Chapter three refers to a not assumed inheritance in Polish law, which is regulated in Code of Civil Procedure, jurisprudence and commentaries.
