The level of intellectual property rights protection provided for in the Polish law is higher compared to that provided for both in the EU law and in the international treaties. Therefore, the adoption of ACTA would not require any significant amendments to Polish law. The authors, however, argue that ACTA should not be ratified. The ratification of ACTA would petrify the current model of rights protection, thus impending changes that are necessary to optimize the balance between conflicting interests. Moreover, it could influence the judicial interpretation of the provisions of the copyright law, making it more restrictive than it is currently. The authors suggest that mass protests concerning ACTA provide a good starting point for the desired clarification and extension of the scope of permitted use, as well as for redesigning exclusions concerning the liability of the host providers.
