Abstract in English

The article presents problems related to the difficulties of evidence in the scope of determining the subjective side of the crime of theft. According to art. 278 § 1 polish penal code this offense can only be committed with direct intent. Therefore, determining this intention is crucial to assigning the perpetrator of criminal responsibility. Clarification also requires the determination of the appropriate moment in time when the perpetrator's actions constitute theft, and when only its attempt.
