The crime of abuse as a manifestation of violence against women

Tematem niniejszej pracy magisterskiej jest przestępstwo znęcania się jako przejaw przemocy wobec kobiet. Praca skupia się na rozważaniach dotyczących zarówno psychologicznych jak i prawnych aspektów przemocy wobec kobiet, ze szczególnym uwzględnieniem przestępstwa znęcania się jako mechanizmu zwalczania tego zjawiska. W pracy przeanalizowane zostały przyczyny i skutki zjawiska. Skonstruowany został także psychologiczny portret ofiary i sprawcy. W rozdziale 2 zwrócono uwagę na międzynarodowe uregulowania dotyczące przemocy w rodzinie na poziomie ONZ, Rady Europy oraz Unii Europejskiej. Omówiono także uregulowania krajowe, w szczególności w postaci ustawy o przeciwdziałaniu przemocy w rodzinie oraz procedury Niebieskiej Karty. Ze szczególną uwagą zostało również scharakteryzowane przestępstwo znęcania się z art. 207 k.k.. wraz z rozważaniami dotyczącymi penalizacji przemocy ekonomicznej na gruncie prawa karnego. W pracy przedstawiono również statystyki oraz wyniki przeprowadzonych badań aktowych dotyczących zjawiska przemocy wobec kobiet i przestępstwa znęcania się.

The subject of this Master's thesis is the crime of abuse as a manifestation of violence against women. The thesis focuses on considerations of both psychological and legal aspects of violence against women, with particular emphasis on the crime of abuse as a mechanism for combating this phenomenon. The paper analyses the causes and consequences of the phenomenon. A psychological portrait of the victim and the perpetrator is also constructed. Chapter 2 draws attention to the international regulations concerning violence in the family at the level of the United Nations, the Council of Europe and the European Union. It also discusses national regulations, in particular in the form of the Act on Counteracting Family Violence and the Blue Card procedure. Particular attention was also paid to the characterisation of the crime of abuse under Article 207 of the Penal Code. Together with considerations on the criminalisation of economic violence on the grounds of criminal law. The paper also presents statistics and results of the conducted file research on the phenomenon of violence against women and the crime of abuse.
