Guarantees of independence of national preventive mechanisms established on the basis of the OPCAT

Celem Protokołu fakultatywnego do Konwencji w sprawie zakazu stosowania tortur oraz innego okrutnego, nieludzkiego lub poniżającego traktowania albo karania (OPCAT) jest ustanowienie kompleksowego globalnego systemu prewencji dla wykrywania ryzyka stosowania tortur. Podkomitet do spraw Prewencji jest organem traktatowym odpowiedzialnym za monitorowanie systemu na szczeblu międzynarodowym. Ponadto państwa-strony OPCAT utrzymują, wyznaczają bądź tworzą na szczeblu krajowym jeden lub kilka organów wizytujących (krajowy mechanizm prewencji). Krajowe mechanizmy prewencji, aby wykonywać swoje zadania, muszą posiadać rzeczywistą niezależność funkcjonalną, w tym w zakresie ustawowego mandatu, niezależności operacyjnej oraz niezależności finansowej. Państwa-strony powinny również zagwarantować niezależność swojego personelu. The objective of the Optional Protocol to the Convention against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment (OPCAT) is to establish a comprehensive global system of prevention in order to detect risk of torture. The Subcommittee on Prevention of Torture (SPT) is a treaty body responsible for monitoring this at an international level. Moreover, the State Parties of OPCAT set up, designate or maintain at the domestic level one or several visiting bodies for the prevention of torture (national preventive mechanism, NPMs). NPMs need to enjoy true functional independence to exercise their mandates, including a legislative mandate, and operational and financial independence. The State Parties should also guarantee the independence of their personnel. The OPCAT does not provide further requirements on how to ensure the independence of NPMs. However, the guarantees of independence could be evaluated from the recommendations of the SPT.
