Rozdział przedstawia stosowanie przez sądy polskie dwóch rozporzadzeń rzymskich: tzw. "Rzym I" (Rozporządzenie Parlamentu Europejskiego i Rady (WE) nr 593/2008 z dnia 17 czerwca 2008 r. w sprawie prawa właściwego dla zobowiązań umownych) i "Rzym II" (Rozporządzenie (WE) nr 864/2007 Parlamentu Europejskiego i Rady z dnia 11 lipca 2007 r. dotyczące prawa właściwego dla zobowiązań pozaumownych ) stanowiących trzon międzynarodowego prawa zobowiązań i zrazem dwa fundametalne źródła prawa prywatnego międzynarodowego Unii Europejskiej.
Abstract in English
The chapter discusses the application of the Rome I Regulation (Regulation (EC) No 593/2008 of the European Parliament and of the Council of 17 June 2008 on the law applicable to contractual obligations) and Rome I Regulation (Regulation (EC) No 864/2007 of the European Parliament and of the Council of 11 July 2007 on the law applicable to non-contractual obligations) by the Polish Courts. These two regulations form the cornenr stone of the international law of obligations being at the same time they constitute two main sources the private international law of the European Union.
