Acquisition of a share in real property by way of usucaption
In the article the author deals with the quite common problem of acquisition of a share in real property by way of usucaption (acquisition of property right by force of law after 20 or 30 years of possession). The problem may appear quite complicated as it requires very detailed analysis and proper interpretation of various articles of the civil code regarding co-ownership, usucaption and possession. Situations described in the article, in which the effect of acquisition of share in property right may be possible, are often very specific. This makes it difficult to create general rules that would be applicable to all situations. The author, gathering information from different sources, presenting judgements of The Supreme Court and available literature, tries to give complex information about the topic.
