The Republic of Kosovo: legal status and personality under public international law

Głównym zagadnieniem niniejszej pracy jest Republika Kosowa, w szczególności ocena jej statusu prawnego i podmiotowości w świetle prawa międzynarodowego publicznego. W pierwszej kolejności zostało obszernie przeanalizowane kształtowanie statusu prawnego Republiki Kosowa w składzie Republiki Serbii pod wpływem różnych czynników polityczno-prawnych, a także jego skutek w postaci jednostronnej proklamacji niepodległości Republiki Kosowa. Drugi rozdział poświęcony jest problematyce podmiotowości Republiki Kosowa, do której umiędzynarodowienia bezpośrednio przyczyniła się opinia doradcza Międzynarodowego Trybunału Sprawiedliwości w sprawie legalności jednostronnej deklaracji niepodległości Republiki Kosowa. W kontekście podmiotowości podjęto próbę odpowiedzi na pytanie, czy Republika Kosowa może być uznana za państwo w świetle prawa międzynarodowego publicznego, a także przedstawiono stanowiska członków społeczności międzynarodowej najbardziej zaangażowanych w sprawę Kosowa. Ostatni rozdział ma na celu ocenę działań Republiki Kosowo zmierzających do zbliżenia się do procesu integracji europejskiej, a także ich efektów w postaci osiągnięcia kluczowych porozumień normalizujących relacje między Republiką Kosowa i Republiką Serbii.

The main issue of this work is the Republic of Kosovo, in particular the assessment of its legal status and its personality under public international law. In the first place, the shaping of the legal status of the Republic of Kosovo in the composition of the Republic of Serbia under the influence of various political and legal factors, as well as its effect in the form of a unilateral proclamation of the independence of the Republic of Kosovo, have been extensively analyzed. The second chapter deals with the issue of the independence of the Republic of Kosovo, to which internationalisation the International Court of Justice's advisory opinion on the legality of the unilateral declaration of independence of the Republic of Kosovo contributed directly. In the context of subjectivity, an attempt was made to answer the question whether the Republic of Kosovo can be considered a state under public international law, and the positions of the members of the international community most involved in the Kosovo issue were presented. The final chapter is aimed at assessing the efforts of the Republic of Kosovo to move closer to the process of European integration and their results in the achievement of key agreements normalizing relations between the Republic of Kosovo and the Republic of Serbia.
