Taking of evidence in international commercial arbitration in the light of IBA and Prague - Rules

Monografia przedstawia zasady postępowania dowodowego funkcjonujące w praktyce międzynarodowego arbitrażu handlowego, w świetle dwóch instrumentów "miękkiego prawa" jakimi są IBA Rules on the Efficient Conduct of Proceedings in International Arbitration Prague Rules (Regulamin dowodowy IBA), oraz Rules on the Efficient Conduct of Proceedings in International Arbitration - Prague Rules (Zasady Praskie). Rozważania zostały poświęcone zasadzie autonomii woli stron w kształtowaniu postępowania dowodowego, dowodzie z zeznań świadka, dowodzie z opinii biegłego oraz dowodzie z dokumentu, ze szczególnym uwzględnieniem procedury ujawnienia dokumentu na rzecz strony przeciwnej ( tzw. ang. "docuemnt prodution"). W monografii znaleźć można również min. rozważania poświęcone funkcjonowaniu zasady łac. iuria novit curia w międzynarodowym arbitrażu handlowym oraz instytucji wyciągnięcia przez trybunał arbitrażowych negatywnych dla strony wniosków, na podstawie niezastosowania się strony postępowania do zarządzenia zespołu orzekającego tzw. ang. "adverse inference".

This master’s thesis analysis evidentiary rules functioning in international commercial arbitration practice in the light of two soft law instruments: IBA Rules on the Efficient Conduct of Proceedings in International Arbitration Prague Rules (IBA Rules) and Rules on the Efficient Conduct of Proceedings in International Arbitration (Prague Rules). This master's thesis concentrates on the limits of the party autonomy rule in agreeing to evidentiary rules in international commercial arbitration, witness evidence, expert witness evidence, documentary evidence with a particular consideration of docuemnt production. The master's thesis also contains an analysis of the"iuria novit curia" rule in international commercial arbitration, as well as an analysis of drawing adverse inferences from the non-production of evidence, so-called "adverse inferances".
