Law on counteracting drug addiction vs. consti-tutional principle of proportionality

Przyjęty w Polsce model przeciwdziałania narkomanii opiera się na założeniu, że szeroko stosowane sankcje karne stanowią skuteczną metodę walki ze zjawiskiem używania i nadużywania narkotyków. Ustawodawca przyjął również, że w ograniczaniu produkcji i dystrybucji zakazanych środków skuteczne będzie karanie posiadania każdej ich ilości. Autor opisuje konsekwencje tych założeń, szczególną uwagę poświęcając problemowi konfliktu między wyrażoną w art. 31 ust. 3 Konstytucji zasadą proporcjonalności, a praktyką działania policji i prokuratury. Argumentuje również, że obowiązujące regulacje, głównie za sprawą wprowadzenia kategorii przestępstw z posiadania, naruszają pewien szczególny, formalny aspekt tej zasady.

Adopted in Poland, the model of counteracting drug addiction is grounded on the assumption that, when widely applied, penal sanctions constitute an effective method for fighting drug use and abuse. The legislator has also assumed that punishing for possession of any amount of prohibited sub-stances will constitute an effective measure that limits the drug production and distribution. The article describes consequences of the said assump-tions, paying particular attention to a conflict between the principle of propor-tionality under Article 31, clause 3 of the Constitution, and the police and prosecutor’s office practices. It is also argued that the regulations in force, mainly due to the introduction of the possession offence category, violate a certain particular formal aspect of the said principle.
