Agreements used in the production and distribution of audiovisual works

Celem niniejszej pracy magisterskiej jest przedstawienie i omówienie umów wykorzystywanych w produkcji i dystrybucji utworów audiowizualnych. Praca została podzielona na pięć rozdziałów. Pierwszy z nich stanowi wstęp dla rozważań o możliwości przenoszenia autorskich praw majątkowych. Drugi rozdział stanowi odpowiedź na pytanie: „Kim jest twórca?”. Jednocześnie zostało w nim opisane zagadnienie współautorstwa, szczególnie istotne w przypadku omawianego rodzaju utworów. Trzeci rozdział został w całości poświęcony na opisanie czym jest utwór, ze szczególnym uwzględnieniem możliwości rozumienia pojęcia utworu audiowizualnego. Czwarty rozdział jest omówieniem przepisów dotyczących umów prawnoautorskich – tych przenoszących autorskie prawa majątkowe oraz umów licencyjnych. W ostatnim rozdziale odnajdziemy omówienie najczęściej występujących umów w produkcji i dystrybucji utworów audiowizualnych.

The aim of the following thesis is to present and discuss agreements used in the production and distribution of audiovisual works. The thesis is divided into five chapters. The first one is an introduction to the consideration of the possibility of transferring author's economic rights. The second chapter is an answer to the question: "Who is the author?". At the same time, it describes the issue of co-authorship, particularly important in the case of this type of works. The third chapter is entirely devoted to the description of what a work is, with particular emphasis on the possibility of understanding the concept of an audiovisual work. The fourth chapter is a discussion of regulations concerning copyright agreements - those transferring author's economic rights and license agreements. In the last chapter we will find a discussion of the most common agreements in the production and distribution of audiovisual works.
