W niniejszej pracy autor przedstawia pokrótce typologię modeli kontroli konstytucyjności prawa, jakie występują na świecie i przekłada to zagadnienie na grunt polski, charakteryzując model przyjęty przez ustrojodawcę w Polsce. W dalszej kolejności autor omawia wyróżniane w doktrynie sposoby stosowania ustawy zasadniczej i wskazać najważniejsze normy konstytucyjne, z którymi wiąże się możliwość dokonywania przez sądy krajowe kontroli rozproszonej, prezentuje dotychczasowy dorobek naukowy i orzeczniczy związany z tematyką dopuszczalności kolizyjnego stosowania Konstytucji, odmawiania stosowania przepisów ustawowych i problemów, jakie kontrola ta może sprawiać w szerszej perspektywie. Całość wywodu uzupełnia przy tym analiza aktualnych trendów w orzecznictwie na przykładzie wybranych orzeczeń sądów.

In this thesis, the author briefly outlines a typology of models of control of the constitutionality of the law that exists in the world and transposes this issue to Poland, characterizing the model adopted by the Polish constitutional legislator. Next, the author discusses the ways of applying the Polish Basic Law, distinguished in the doctrine, and indicates the most important constitutional norms, with which the possibility of dispersed control by national courts is associated; he presents scientific and jurisprudence achievements to date related to issues of admissibility of conflicting application of the Constitution, the refusal to apply statutory provisions and the problems that this control may cause in a wider perspective. The whole argument is complemented by the analysis of current trends in jurisprudence on the example of selected court decisions.
