Opracowanie dotyczy art. 31(2) Karty Praw Podstawowych UE, zgodnie z którym każdy pracownik ma prawo do corocznego płatnego urlopu. Autor przedstawia regulacje prawa unijnego oraz znaczenie Karty Praw Podstawowych UE dla prawa do urlopu wypoczynkowego. Analizuje prawne ramy, podmiotowy i przedmiotowy zakres prawa do urlopu wypoczynkowego, a także orzecznictwo Trybunału Sprawiedliwości Unii Europejskiej w tej dziedzinie. Zdaniem autora, największe znaczenia dla wzmocnienia efektywności prawa do urlopu wypoczynkowego jest uznanie przez TSUE bezpośredniego skutku horyzontalnego art. 31(2) Karty. W rezultacie przepis ten może stanowić podstawę roszczeń w sporach pomiędzy pracownikami a pracodawcami w sektorze prywatnym.

The elaboration focuses on art. 31(2) CFREU that provides that every worker has the right to an annual period of paid leave. Author presents the regulations of Union law and the significance of the EU Charter of Fundamental Rights for the worker’s right to holiday leave. He analyzes legal framework, personal and subjective scope of the right to holiday leave, as well as the case-law of the Court of Justice of the European Union on that matter. In Author’s opinion, the major contribution for strengthening the effectiveness of the fundamental right to paid annual leave is the CJEU’s recognition of horizontal direct effect of art. 31(2) CFREU. Consequently, this provision can may be relied on in disputes between workers and employers in private sector.
